Employment Law Mediation

Mediation is a form of Alternative Dispute Resolution (ADR). Employment law mediation is a voluntary, confidential, cost-effective and informal process that helps people resolve employment disputes early, without litigation. Mediation improves communication; which can lead to mutually satisfactory resolutions. As a trained mediator, Elissa facilitates the exploration and discussion of grievances, addresses misunderstandings, identifies the most important issues at hand, and works with the parties toward a mutually acceptable resolution. Elissa is adept at identifying the often complex and nuanced issues that often define employment disputes. In mediation, Elissa is impartial and has no authority to decide who is right or wrong or impose a settlement. Instead, Elissa uses creative and facilitative techniques to help the parties come up with their own solutions. Mediation services are individually tailored, it may be facilitative or evaluative; based on the needs and goals of the parties.

Employment Arbitration

Arbitration is a binding out-of-court method for resolving employment law claims. Arbitration is intended to be a quicker, easier, and less expensive way to resolve disputes than a regular trial. Employment arbitrations can result from post-dispute arrangements made by the agreement of the parties. Often, however, they arise as a condition of employment or “pre-dispute agreement” with terms that are established by the employer. Elissa serves as an impartial and neutral decision-maker called an “arbitrator” in arbitration hearings, concerning all manner of employment law matters. She is a member of the Roster of Neutrals for the Employment Panel of the American Arbitration Association (AAA).
